An Optimal IP System in 2035? Over the last two decades the theory of responsive regulation has become highly influential, both in terms of its impact on regulatory scholarship as well as its uptake by regulatory agencies. Fast forward to 2035: What might the optimal IP system look like? Drawing on examples from the patent system, traditional knowledge and trade marks, this talk asks whether and how we are moving toward the ideal embedded in responsive regulation: a system of decision-making that is open to new sources of knowledge and driven more by purposes and consequences than rules.
